User Agreement:

• You must adhere to the rules and guidelines mentioned in the terms and conditions of using our website, any failure to do so may result in corrective or legal action
• This agreement is formed between you and www.hisnherdeals.com.au (ABN 58 004 302 346)
• By visiting or actively using our website you agree to be bound by the agreement formed
• We may amend the agreement at any time with it being effective upon being posted on our website

Registration:

• In order to make purchases or use certain functions of the website you will need to register for membership on the site which is free of charge
• You may not access another users account without their expressed permission
• In order to register you must provide certain personal information such as your name, gender, email address, postcode, age – you must provide correct information and keep it current
• You are responsible for the activity on your account and must maintain a secure password for the site
• If you believe that your account is no longer secure you must notify us immediately at support@hisnherdeals.com.au
• His N Her Deals reserves the right to refuse registration or cancel a member’s account if it was opened in a fraudulent or illegal manner, you have breached the agreement, is compelled to do so by applicable law or in the event that you already have an account
• In the event of you account being closed, either by your request or at our discretion, any residual credit in your account will not be available to be redeemed for cash or other such credit, it is regarded as non-transferable

Legal Capacity:

• In order to purchase a voucher through www.hisnherdeals.com.au you must be over the age of 18
• Should we suffer any loss or damage through the purchase of a voucher by a minor, www.hisnherdeals.com.au reserves the right to take legal action or seek compensation from the parent/s or guardian/s of the minor

Use of website by you:

• You agree not to access the website through any other means than by the portal we offer to you
• You agree not to engage in activity that disrupts the website or service that we offer
• You agree not to interfere with any security provided by the site
• You agree not to copy or distribute any content shown on the site
• You agree that any activity that we suspect is fraudulent or illegal may result in us contacting the appropriate law enforcement agents in order to halt any such actions or conduct

Information on the website:

• Information provided by suppliers in relation to deals are not checked by us for inaccuracies and are considered to be true
• We cannot be held responsible for incorrect or inadequate information provided by a supplier or manufacturer
• You must make your own enquiries in relation to the suitability of the products or services before you purchase any deal

Supply of website services to you/ Termination:

• We reserve the right to change the website at any stage and do not guarantee a constant layout of the site, or that access will be available through the same equipment or software used prior to any changes
• We may halt providing access to our site either on a temporary or permanent front at our discretion and without providing notification
• We reserve the right to terminate your account or restrict access at any stage without liability to you or any third parties affected

Disclaimer:

• Upon providing services to you we acknowledge that occasional errors may occur resulting in disruptions of service. We will not be liable for any loss or damage caused unless otherwise stipulated by law.

• Our liabilities in relation to warranties on purchases made on the site will be limited to, and specified by us:

Price:

• The prices shown are in Australian dollars and include GST where applicable
• Prices shown on the site are subject to change

Payment:

• All payments must be received in full prior to voucher delivery for the deal being issued.
• If your payment is not received due to being declined by your bank then the voucher will not be reserved for you.
• Payments are handled by Payment Express (our third party service provider) please view their website for information regarding their privacy and security policies.
• This website supports secure socket layers of 128 bit or greater

Orders:

• Products or services on offer on the site do not constitute an offer to sell and are to be considered only as an invitation
• Vouchers purchased on the site are governed by the terms and conditions stipulated for the voucher by the supplier
• We reserve the right to accept or reject your offer for the deals at any stage due to unavailability of product or service, price or description error as well as any errors in your order. If your deal is cancelled we shall provide a full refund of any payment received.
• Once your order is placed you cannot cancel it

Delivery of Voucher:

• Your voucher purchased on the site will be made available through your account or email address
• We are not responsible for any damage or loss resulting in a failure of delivery for the voucher if it is blocked by a firewall or filter or where an incorrect email address has been provided

Voucher redemption/ Supply of product:

• The deal available on our site is redeemable for the product shown for the offer. The supplier is the seller of the deal and is solely responsible for honouring the voucher.
• We make no warranty or guarantee regarding standards of the products/ services
• The voucher may not be redeemed for cash unless a refund is required as previously stated in this agreement
• The voucher cannot be combined with any other offers unless otherwise stipulated by the supplier
• We, nor the supplier are responsible for lost or stolen vouchers, or fraudulent use of a voucher reference number
• We are unable to assist in disputes with suppliers, any issues relating to the supplier should be addressed directly with them
• We receive payments from suppliers in exchange for listing their offer on the site once a deal is activated

Bookings and cancellations:

• Products and services are subject to availability. We cannot guarantee that your preferred time and date will be available with the supplier. We recommend that you book in advance where possible
• Bookings are subject to suppliers’ policies
• Cancellation fees may apply for bookings as stipulated by the supplier
• Suppliers may change or cancel a booking at any stage and reschedule. We are not liable for any costs resulting from such action

Voucher expiry and extension:

• The voucher expires as per the date shown on voucher
• Once vouchers have expired they may not be redeemed for any cash amount and are considered invalid by both our business and the supplier of the deal

Refunds:

• Vouchers cannot be exchanged for cash or credit simply due to you changing your mind or are unable to use the voucher prior to its expiry, if damaged, or lost/ stolen
• We will provide a refund of the purchase price where we have made a mistake
• We will try our best to assist you if you experience issues with a supplier but cannot guarantee their actions, if a supplier has ceased business or offering the product/service described in the deal then we will provide a full refund for the purchase price of the associated voucher during the voucher validity upon such request
• If you purchase a deal and it does not reach its activation target then you will be issued a full refund for the purchase price of the voucher after the offer expires on the His N Her Deals website

Complaints or issues:

• We have no liability for acts, omissions, defaults or negligence resulting from a third party or supplier. Where our liability cannot be excluded our liability is limited to the value of the voucher purchased. Please contact us via the “Support” section of the His N Her Deals website if you require assistance

Our liability:

• We are not liable for any content unless it originates from our business, you use the website at your own risk
• In order to make submissions to the website you must be a member of our service
• As a member you must not post the following content:

1. Where you do not have the right
2. Misleading or deceptive
3. Incites hatred or discrimination
4. Is offensive or indecent
5. Infringes copyright, trademark, patent or any other intellectual property
6. Viruses or other software that would disrupt or harm the service
7. Unsolicited advertising material
8. We have the right to refuse any content posted without providing reason
9. We may obtain a copy of any content submitted to the site even when withdrawn from view

Transfer and assignment:

• If at any stage we sell or merge with a third party, we reserve the right without giving notice or consent, to transfer or assign the personal information, contents and rights that we have collected from you

Intellectual property:

• We reserve the right to all intellectual property on the site, this includes trademarks, logos, domain names and other distinctive brand features
• Other trademarks and logos used on the site have the expressed permission of the owner and remain their property at all times
• By submitting to the site you grant us permission to use such content without payment of monies or share in profits, in order to promote the site

Indemnity:

• You will at all times indemnify, and keep indemnified, us and our directors, officers, employees and agents from and against any loss (including reasonable legal costs and expenses on a full indemnity basis) or liability incurred or suffered by you or by us arising from any claim, demand, suit, action or proceeding by any person against you or us where such loss or liability arose out of, in connection with or in respect of your conduct or breach of this agreement

General provisions:

• We are not responsible in any part for delays caused beyond our control in performing our obligations
• This agreement will be governed by Victorian and Federal law where applicable

Account Credits:

• Credit in your His N Her Deals account is non-transferable and may only be used only for purchases through the His N Her Deals website
• A credit usage limit of $5 applies to each purchase on the His N Her Deals website, this limit may be changed at any stage at the discretion of the His N Her Deals Team
• If you cease to be a member of the His N Her Deals website any remaining credit in your account will be forfeited

Privacy Policy

1. Online payments are handled by Payment Express (our third party service provider) please view their website for information regarding their privacy and security policies.
2. Personal information is not collected if you simply visit our site.
3. Your personal information is used for purchasing orders and email updates related to His N Her Deals only. If you do not wish to receive updates please advise us by emailing us – support@hisnherdeals.com.au
